注册美国商标说明

１．商标使用：美国商标是使用在线，因此先使用比先注册还要重要。

２．商标注册：在提出申请之同时，需提示一份已在美国地区使用之证明，如无使用证明，则必需在申请之后注册之前，宣誓注册后将如何使用，及已在美国地区使用之证明文件。

３．商标种类（正商标）：表示自己经营的商品、并有使用的意愿，专用商标者应办理申请注册。

服务标记：不是表示商品，而是表示所提供之服务。

４．美国商标注册分类：美国商标采用国际分类。

５．美国商标申请时间：美国商标申请约12～18个月。

６．美国商标注册专用时间：自注册日之日起十年，到期后要申请延续注册。

７．注册商标使用需知：注册后每五年需公告一次，公告仍在使用或提出相关证明。

美国专利商标

发明专利：其保护年限为申请日起二十年、需缴纳维持费，共缴纳三次，分别为注册日起第三年半、七年半及十一年半。需要直接进行审查，核准后获颁注册证书并同时公告。

新式样专利：其保护年限为注册日起十四年，不需缴纳年费。

美国商标注册：

美国对商标采取使用主义，其保护年限为注册日起十年，可延期多次，每次十年。如果已经在美国使用该商标，可以根据实际使用提出申请，但需同时提出使用的相关证明以及在美国使用日期。在核准后即可获的美国商标注册证书；如未使用该商标者，可以根据计划使用提出申请，但必须在核准后六个月内提出使用证明及在美国使用商标的日期，该使用证明获得认可后才可以取得美国商标注册证书。

商标(trade mark)

比较起专利权，注册商标在申请手续上会较为简单。根据商标名称的选 用，提交注册申请。商标可不注册(register)而使用，但经过正式注册的商标才有正式的商标使用权。

美国商标注册许可的的使用权时间为六年。

 

美国商标申请过程:

1) 注册美国商标初部调查(Knock-out Search)：这是初步的过虑步骤，律师先行判断，并透过计算机筛检判定这商标是否已

使用，经过查寻了解欲申请的商标可否申请批准通过。

2) 完整调查(complete Search)：在通过初步的查询及准备以后，如果此商标有可能使用，律师再进一步研究 提出专业法律上的建议。时间约 7 - 10 天。

 

3) 注册美国商标案件送审：一整个商标注册申请案件费用，含Knock-out Search, Complete Search ，案件申请费，律师费等，约美金2000左右 。若有数个相类似案件同时一起申请， 则可以节省服务费用。整个案件由申请到审核发布结果，一般需要12～18个月。假使遭到拒绝，可在研究讨论后再重新提出新的申请。若万一无法取得此商标时，就可考虑申请次 级商标注册，,此商标一旦取得亦可使用五年。

强势标记或具备第二层意义(Secondary Meaning)的标记可以直接做主要注册

说明性标记可以用已具备第二层意义争取附属注册

此费用包括准备和处理必须的授权书文件、协助申请人选择申请类别﹑准备和提交申请、缴付官方费用以及报告申请资料﹑报告公告的许可通知﹑办理公告事宜﹑报告获准注册通知、领取及寄上注册证书以及缴付官方费用。

Validity: TEN (10)years 有效期为十年。

 

Ⅲ. MISC.(Additional Service Charges 额外服务)

a) Statement of “Intend to Use” 准备将会使用的声明 $3，000 $390

If the trademark is not yet used in USA, it is necessary to prepare this Statement of Intend to Use. If the trademark is currently used in the USA in business activities, this fee can be eliminated.

(The fees consists of preparing the statement of Intend to Use, obtaining execution and filing statement with Patent and Trademark Office)

如商标尚未在美国使用，那就必须准备一份将会使用哪个商标的声明。如商标已在美国使用，费用便可免除。

Note: Before getting the certificate, three specimens or photo of the marks on goods (for goods mark ) or on ads literature (for service mark) should be submitted together with first used date in any where and in interstate or international commerce within half year time. The date can be the same.

备注：在拿到证书之前，必须提交3张照片的样本（有关产品的商标）或广告文章样本（有关服务商标）并连同在任何地方半年内的第一次商业使用证明。
